It was exciting again at whistleblowing Today, Break the Silence, episode 7. We were allowed to look behind the scenes and hear and learn from an experienced CEO. Our guest was Mr Oliver Kraft, CEO of voestalpine Railway Systems.
Compliance and risk management deluxe. Voestalpine AG in Austria is a listed technology group with €14.5 billion in revenue in 21/22 and more than 500 locations and 50 thousand employees worldwide. Mr Kraft reported on his experiences with compliance violations. We spoke anonymously about real cases that Oliver had experienced in his long career and whose clarification he had been responsible for as a board member. The clarification of violations is the responsibility of the management. We also talked about “lessons learned” and practical tips that apply equally to SMEs and corporations.

Our guest was Dr Martin Weimann, an experienced lawyer who has been advising investors of all sizes in stock and capital market law for decades. He reported on the importance of short sellers. Are short-sellers an asset or public enemy number one?
The Wirecard scandal and the Adler affair brought the topic of shortsellers back into the headlines. British shortseller Matthew Earl failed in his attempt to put an end to the fraudulent goings-on of the Wirecard Group. One year before the collapse of the company, he provided new information about money laundering to the Munich public prosecutor.
Short-seller Fraser Perring reported Adler Group as a “hotbed of fraud, deception and financial misrepresentation” and bet on a falling share price.
We will talk about these and other scandals and shed light on the role of the shortseller.

Our guest was Mr. Karsten vom Bruch, who has already reported on the subject of Dieselgate in various media. As a former works council member of Bosch, he was subjected to reprisals after his 20-year career after he pointed out the issue of false diesel emissions internally.
Today, he advises companies on issues including corporate culture change, applied business ethics, encouraging whistleblowers, and creating a corporate environment conducive to innovation.
We talked about the topic of protecting whistleblowers and the important Speak Up culture and how whistleblowers can be protected better in the future, even if the legal framework does not offer complete protection. Better protection of whistleblowers leads in particular to better risk management, for example in the avoidance of reputational damage.

Our second guest was Dr. Sebastian Oelrich, head of the whistleblower working group at Transparency International Germany e.V. At the Technical University of Dresden, he researches and teaches on the topics of accounting, whistleblowing, auditing and business ethics.
The Federal Ministry of Justice has invited Transparency International Germany as well as other associations to comment on the draft bill in the course of the implementation of the EU Whistleblowing Directive until May 11th, 2022. Among other things, we discussed TI’s position, proposed amendments and shed light on the economic consequences of whistleblowing.

Uwe Dolata was our first guest. He dealt with the fight against corruption for more than 25 years as a white-collar criminologist and has many years of experience in advising companies and public administration, especially in setting up compliance management systems. As a white-collar criminologist at the University of Applied Sciences Wuerzburg, Faculty of Economics, he teaches “Compliance as an Anti-Corruption Strategy” and in the Master’s programme “Compliance & Data Protection” Compliance for MBA.
He is the author of several specialist books and a publicist in trade journals on the subject of compliance versus corruption. Time and again he appears as a criminologist in radio and television programmes and interviews in the print media. As a supervisory board member, he watches over various companies. Uwe talked about the hard times for whistleblowers and his hope and ideas for a change in the future.
